SuperStrive Terms of Use

These Terms of Use ("Terms") govern your use of the SuperStrive app and related services.
By using SuperStrive, you agree to these Terms.

1. Eligibility

You must be legally able to enter into these Terms under applicable law in your region.

2. Fitness/Wellness Use Only (No Medical Use)

SuperStrive is for fitness and wellness purposes only.

SuperStrive is not a medical device or medical service and does not provide diagnosis, prevention, monitoring, or treatment of disease.

Always consult a qualified healthcare professional for medical concerns.

3. Account and Security

You are responsible for:

• Providing accurate account information
• Keeping your credentials secure
• Activities occurring under your account

4. Health and Device Permissions

Some features require permissions (for example HealthKit, location, microphone, speech recognition, photo library).

You can grant or revoke permissions at any time in iOS Settings.

5. AI Coach Features

AI Coach outputs are generated automatically and may be incomplete or inaccurate.

You are responsible for your decisions and actions based on AI outputs.

Do not rely on AI Coach for medical advice, diagnosis, or treatment.

6. Acceptable Use

You agree not to:

• Use the service for unlawful purposes
• Interfere with app security or integrity
• Attempt unauthorized access to systems or data
• Reverse engineer the service except where legally permitted

7. User Content

You retain rights to content you submit, but you grant SuperStrive a limited license to process it as needed to provide app functionality.

8. Intellectual Property

The app, including software, design, trademarks, and content (excluding your content), is owned by SuperStrive or its licensors and protected by law.

9. Third-Party Services

SuperStrive may rely on third-party services (such as Apple platform services, authentication services, and AI provider endpoints).

Your use of those services may also be subject to their terms and policies.

10. Disclaimers

The service is provided on an "AS IS" and "AS AVAILABLE" basis, to the maximum extent permitted by law.

We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, SuperStrive is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or business.

12. Termination

We may suspend or terminate access if you violate these Terms or if required for legal, security, or operational reasons.

13. Changes to These Terms

We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

16. Apple App Store Notice

If you downloaded SuperStrive from the Apple App Store, you acknowledge that: (a) these Terms are between you and SuperStrive, not Apple; (b) Apple is not responsible for the app or its content; (c) Apple has no obligation to provide maintenance or support for the app; (d) to the extent required by applicable law, if the app fails to conform to an applicable warranty, you may notify Apple for a refund of amounts paid (if any); (e) Apple and its subsidiaries are third-party beneficiaries of these Terms regarding your use of the app and may enforce these Terms; and (f) you must comply with applicable third-party terms when using the app.
