Welcome to SuperStrive. These Terms of Service apply to your access to and use of the SuperStrive app, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.

1. Description of the Service

SuperStrive is a product designed to help users build a more sustainable rhythm of exercise, recovery, focus, and behavior. The Service may include workout tracking, health data access, movement detection, AI coaching, screen time rewards, focus controls, app restrictions, and related features. We may update, change, suspend, or discontinue parts of the Service from time to time.

2. Eligibility

You must meet the minimum age required by the laws of your jurisdiction and have the legal capacity to enter into a binding agreement in order to use the Service.

If you are not legally an adult in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.

3. Accounts and Security

Some features may require you to create an account or sign in through a third-party service.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

If you believe your account has been accessed without authorization, please contact us promptly.

We may suspend or terminate your access to the Service if we reasonably believe there has been abuse, fraud, unlawful activity, or a violation of these Terms.

4. Health and Exercise Notice

SuperStrive's workout suggestions, movement feedback, recovery prompts, AI coaching analysis, and related features are provided for general wellness, fitness support, and informational purposes only. They do not constitute medical advice, diagnosis, or treatment.

You are responsible for deciding whether any workout or physical activity is appropriate for your condition, experience, and environment. If you have any illness, injury, pain, pregnancy-related concerns, post-surgical recovery needs, or any other condition that may affect your ability to exercise safely, please consult a physician or other qualified healthcare professional before using the Service.

You assume the risks associated with any training, exercise, or lifestyle adjustments you make based on your use of the Service, except where liability cannot be excluded under applicable law.

5. Device Permissions and Related Features

Certain features of the Service may require access to Apple Health / HealthKit, camera, microphone, location, Screen Time-related system capabilities, or other device permissions.

You may choose whether to grant these permissions, and you may revoke them at any time through your device settings. If you decline or revoke permissions, some features of the Service may not function, or their results may be limited.

Camera-based movement detection, rep counting, AI features, screen time rewards, focus controls, app restriction or app lock features may be affected by device model, operating system version, permission status, platform capabilities, and third-party rules. We do not guarantee that these features will always be available, accurate, or effective on every device, in every region, or under every condition.

App restriction, app locking, and time budgeting tools are intended only as supportive behavioral tools and are not guaranteed to fully prevent access or distraction.

6. AI Features

SuperStrive may provide AI coaching, summaries, suggestions, and other intelligent assistance features. AI-generated output may be inaccurate, incomplete, delayed, outdated, or not suitable for your specific circumstances, and is provided for reference only. You are responsible for deciding whether to rely on AI output and for any actions you take based on it. If you use BYOK ("Bring Your Own Key") mode to connect a third-party AI provider, that provider's terms and privacy policy will also apply to the related use and data processing.

7. Subscriptions and Paid Features

The Service may offer subscriptions, in-app purchases, or other paid features. Payments are typically processed by Apple App Store or other third-party platforms and are subject to their applicable terms and policies.

Except where required by applicable law, fees paid are generally non-refundable. If you subscribe through Apple, subscription management and cancellation are generally handled through your Apple account.

Except for content you lawfully own, the Service and its related software, interface, design, text, graphics, marks, code, and other content are owned by us or our licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, lease, publish, or otherwise exploit any part of the Service without our prior written consent.

10. Third-Party Services

The Service may rely on or connect to third-party services, platforms, or system capabilities, such as Apple Health / HealthKit, iCloud, Sign in with Apple, Apple App Store, Screen Time-related system frameworks, and third-party AI providers.

We do not control those third-party services and are not responsible for their availability, continuity, security, or terms and policies. Your use of such third-party services may also be subject to their own terms and policies.

11. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not guarantee that the Service will always be available, uninterrupted, or error-free, or that workout data, movement detection, AI output, health analysis, screen time controls, or app restriction results will always be accurate, complete, or suitable for your particular situation.

12. Limitation of Liability

To the fullest extent permitted by applicable law, but excluding liability that cannot lawfully be excluded or limited, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, loss of data, business interruption, or other losses arising from your use of the Service. Where permitted by applicable law, our total liability arising out of or relating to the Service will not exceed the greater of: (a) the total amount you paid to us for the Service in the 12 months before the event giving rise to the claim, or (b) USD 100.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, or if we reasonably believe continued access may create risk.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page and become effective as of the updated date.

By continuing to use the Service after updated Terms take effect, you agree to the revised Terms.

15. Governing Law

These Terms are governed by applicable law and will be interpreted accordingly. If consumer protection laws in your jurisdiction give you additional rights or require different mandatory rules, those rules will prevail to the extent required.

16. Apple App Store

If you download the Service through the Apple App Store, you acknowledge that these Terms are between you and us, and not with Apple. Apple has no obligation to provide maintenance or support for the Service and, to the maximum extent permitted by applicable law, has no other responsibility with respect to the Service. Apple and its subsidiaries are third-party beneficiaries of the provisions of these Terms that relate to them.
